At Davenport Solicitors, we are committed to transparency in providing cost information as per the SRA Transparency Rules and the guidance from the Law Society. This information is aimed at assisting both employees and employers seeking guidance on the costs involved in pursuing or defending claims related to unfair or wrongful dismissal in the employment tribunal.

Understanding Costs and Fees

Please note that the costs outlined here are estimates and not binding quotes. Once you engage us, we will provide a personalised fee estimate tailored to your specific case. It’s important to highlight that the cost information offered here is not legal advice but an informative overview.

Our Legal Team and Services

Our dedicated team of legal professionals is well-equipped to handle a range of claims related to unfair and wrongful dismissal. Our services cover:

Unfair Dismissal: If you’re facing an unfair dismissal situation, we’re here to help you navigate the legal process and pursue a fair resolution.

Wrongful Dismissal: In cases of wrongful dismissal, our experts are ready to provide you with expert guidance to ensure your rights are upheld.

Our Fee Structure

We calculate fees based on the time spent by the relevant team members at their hourly rates. The hourly rates range from £100 plus VAT per hour to £350 plus VAT per hour, effective from January 1, 2018. Please note that hourly rates may be adjusted each April. We may also offer lower hourly rates in certain cases.

Cost Estimates for Standard Cases

For a standard unfair or wrongful dismissal claim, our fees range from £5,000 to £20,000 plus VAT. The range accounts for the varying experience levels of our solicitors and advisors, as well as the complexity of the case. Your assigned advisor, typically a qualified solicitor or immigration advisor with at least 4 years of experience, will guide you through the process.

In addition, there may be an additional charge of £750 to £1,500 plus VAT per day for attending the employment tribunal hearing.

VAT and Disbursements

Our fees include the Standard rate of UK VAT, which is currently 20%. However, there are certain circumstances where VAT might not be charged, such as when billing an EU registered company with a VAT number. Detailed information on VAT implications is available for your reference.

Disbursements, which are expenses related to your case, may include travel costs, hotel accommodation, subsistence costs, courier charges, and photocopying costs. We handle disbursements on your behalf and will discuss them with you before they are incurred.

Standard Case Stages and Timescales

We’ve outlined the various stages involved in standard cases of unfair and wrongful dismissal, including estimated timescales. These stages encompass:

  1. Initial instructions and document review
  2. Pre-claim conciliation and claim/response drafting
  3. Preliminary hearings and preparation
  4. Taking witness statements and preparation for final hearing

Additional Services and Complex Cases

For non-standard cases, such as those involving complex issues or automatic unfair dismissal, the fee structure and timeline may vary. We will provide case-specific estimates and work with you to ensure transparency and clarity throughout.
